performance and project / past experience etc.this has no relevance or bearing on the price to be quoted by the bidders and is also not going to have anyimpact on bid participation. also this is not received in bid / ra process. 7. inspection of stores by nominated inspection authority / agency of buyer or theirauthorized representativesan independent third party professional inspection body can help buyer in mitigating buyer s risk with pre-dispatch/post-dispatch inspection in order to ensure that equipment, components, solutions and documentationconform to contractual requirements. the buyer has a right to inspect goods in reasonable manner and withinreasonable time at any reasonable place as indicated in contract. inspection fee/ charges as pre-greed betweenbuyer and inspection agency would be borne by the buyer as per their internal arrangement but may berecovered from the seller if the consignment failed to conform to contractual specification and got rejected bythe inspection officer .if so requested and accepted by the seller, initially seller may pay for inspectioncharges as applicable and get the same reimbursed from buyer if consignment accepted by the inspectingofficer . for reimbursement seller has to submit proof of payment to inspection agency.seller/oem shall send a notice in writing / e-mail to the inspecting officer / inspection agency specifying the place3 / 38 of inspection as per contract and the inspecting officer shall on receipt of such notice notify to the seller the dateand time when the stores would be inspected. the seller shall, at his own expenses, afford to the inspectingofficer, all reasonable facilities as may be necessary for satisfying himself that the stores are being and or havebeen manufactured in accordance with the technical particulars governing the supply. the decision of thepurchaser representative /inspection authority regarding acceptance / rejection of consignment shall be final andbinding on the namely oem cartridges and compatible cartridges2. for parameter product class of cartridge, oem shall mean oem for printers only and not oemfor compatible cartridges. compatible shall mean oem of compatible cartridges only. 3. oem cartridge covered is the cartridge having the brand of the respective printer oem. compatiblecartridge is the cartridge having the brand di erent than the respective printer brand or ismanufactured by an entity other than oem of the printer and is meant to t in a particular printerfor replacing oem cartridges.4. printer oems who are given entry in the category and allowed dashboards can upload catalogues ofoem cartridges choosing product class option as oem. compatible oems are those entities who arevendor-assessed as per the special va criteria applicable availble on gem website by vendorassessment agency of government e marketplace. they are required to upload catalogues strictlyin terms of the va report and choosing product class option as compatible. any deviations byoems/compatible oems in appropriate product class option shall be viewed seriously and result inadministrative actions against the respective seller.5. against parameter type of replacement cartridge/consumable options applicable depending onthe type as cartridge or consumbale is to be chosen while creating catalogue. for example if inkbottle or toner powder bottle are being uploaded the relevant option to be chosen as consumableand if toner catridge is being uploadedoption to be chosen as toner catridge6. parameter model number of oem printer /mfp etc., for which o ered cartridge/consumable issuitable will guide the buyer in identifying the oem or compatible cartridge to be procured for aspeci c printer . while creating catlogues sellers are to ensure that options are chosen accordingto the printer model for which offered catridge is suitable 7. model number of cartridges/consumable o ered by compatible manufacturer indicate suitability of35 / 38 o ered compatible cartridge with the oem cartridge model. for oem also options covering theircatridge model numbers are included against parameter model number of oems printercartridge/consumable. this details along with printer model for which o ered catridge/consumableis suitable shall help in identifying suitability of o ered catridge/consumable by buyers for theprinters/multifunction machines availble with them 8. both printer oems who are uploading catalogues for their oem cartridges as well as compatibleoems are required to get the model/part nos included in drop-down options compatible oems arerequired to get their model nos included in the drop-down options for selection during the creationof catalogues. they are required to submit a list of compatible model nos through the help desk forinclusion and shall create catalogues selecting their model nos only after inclusion creation ofcatalogues choosing incorrect model nos shall be viewed seriously and may result in removal ofcatalogues in addition to other administrative actions ..compatible oems are also required o ensurethat they do not indicate their model no or part no in any manner resembling oem model/part no toavoid confusion to the buyers. 9. name of the oem of cartridge/consumable o ered shall indicate printer oem or name ofcompatible oem as per va report .printer oem or compatible oem are to upload catalogues onlychoosing their name from drop down options after completion of va sellers should approach gemthrough help desk to get name included under options provided against this parameter. dash boardshould be taken for creating catalogue only after including name.10. the buyers are requested to note that, when the oem cartridges for di erent brands of printers areprocured through bunch bids, they should opt for item-wise evaluation and not a total value-wiseevaluation. this shall ensure that resellers of only one of the printer brands will also be able toparticipate in the bid. in the event of total value-wise evaluation only entities who are resellers forboth the printers brands shall be able to participate. further oem and compatible catridges maynot be bunched together.6 6 ; ; a a/buyer added bid specific terms and conditions1. genericoption clause: the purchaser reserves the right to increase or decrease the quantity to be ordered upto 50 percent of bid quantity at the time of placement of contract. the purchaser also reserves the right toincrease the ordered quantity up to 50% of the contracted quantity during the currency of the contract atthe contracted rates. the delivery period of quantity shall commence from the last date of originaldelivery order and in cases where option clause is exercised during the extended delivery period theadditional time shall commence from the last date of extended delivery period. the additional deliverytime shall be increased quantity original quantity original delivery period in days, subject tominimum of 30 days. if the original delivery period is less than 30 days, the additional time equals theoriginal delivery period. the purchaser may extend this calculated delivery duration up to the originaldelivery period
